1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Healthstars Technologies Inc. (“Healthstars,” “we,” “us,” or “our”) governing your use of the Markers application, website, and related services (the “Service”). By using the Service, you agree to these Terms and our Privacy Policy.
2. Eligibility and managed profiles
You must be legally capable of agreeing to these Terms. You may create, access, or manage another person’s profile only if you have their valid permission or other lawful authority. For a child or dependant, you must be the parent, legal guardian, or another person legally authorized to manage the information. You are responsible for choosing appropriate sharing permissions.
3. The Service
Markers helps users record, organize, review, and share health-related information; manage separate profiles; connect optional device services; prepare clinician summaries and request drafts; and use AI-assisted tools. Features may change, differ by device or region, or require permissions and third-party services.
4. No medical advice or emergency service
Markers is not a healthcare provider. Content from Markers, including AI output, summaries, scorecards, targets, suggested questions, or requisition request drafts, is general information and discussion support only. It may be incomplete, outdated, or wrong. It is not a diagnosis, treatment plan, prescription, official medical requisition, referral, or substitute for professional judgment.
Always review health decisions and important information with a qualified healthcare professional. Do not rely on Markers for emergencies. If you may be experiencing an emergency, contact local emergency services immediately.
5. AI-assisted features
AI systems can misunderstand context, invent facts or references, and produce unsafe or unsuitable output. You agree to independently review AI output before using or sharing it and not to use it as the sole basis for a medical decision. Markers may limit, decline, or label certain requests for safety or product-integrity reasons.
6. Clinician summaries and requisition drafts
A clinician summary reflects information recorded in Markers and may omit important facts. A requisition or request draft is a proposed discussion aid only. It is not valid until a licensed professional reviews it and, where applicable, issues or signs the official document. You are responsible for checking names, dates, medications, results, and other details before use.
7. Recording conversations
You may use recording-related features only where lawful and only after obtaining every required person’s informed consent. You must clearly inform participants when recording is active. You are solely responsible for complying with applicable consent, privacy, workplace, clinical, and professional rules and for protecting any recording or transcript you create or share.
8. Apple Health, calendar, and device services
Optional integrations depend on permissions, device settings, operating-system behaviour, and third-party availability. Imported information may be incomplete or delayed. You should verify important measurements and event details at their original source. Apple is not responsible for the Service.
9. Your information and responsibilities
You are responsible for the accuracy, legality, and appropriateness of information you submit; maintaining secure credentials and device access; reviewing profile identity before saving; respecting other people’s privacy; and keeping independent copies of information you need. Do not upload malicious content or use the Service to violate law or another person’s rights.
10. Sharing and collaboration
Information you intentionally share may be viewed or edited according to the permissions you choose. Revoking access limits future access but may not erase copies previously exported or retained by another person. Do not share information unless you understand the recipient, purpose, and scope.
11. Acceptable use
You may not attempt to gain unauthorized access, interfere with the Service, bypass security or consent controls, reverse engineer except where law expressly permits, misuse health information, impersonate another person, or use the Service for unlawful, harmful, or deceptive purposes.
12. Intellectual property
The Service, Markers name and branding, software, design, and related materials are owned by Healthstars or its licensors. Subject to these Terms, we grant you a limited, personal, revocable, non-transferable right to use the Service for its intended purpose.
13. Third-party services
The Service may rely on or link to third-party platforms. Their terms and privacy practices apply separately. We are not responsible for third-party services, content, outages, permission decisions, or changes.
14. Availability and changes
We may add, remove, suspend, or modify features; set reasonable limits; perform maintenance; or discontinue the Service. We do not guarantee uninterrupted, error-free, or permanent availability.
15. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of accuracy, fitness for a particular purpose, non-infringement, merchantability, or uninterrupted availability. Nothing in these Terms excludes rights that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by law, Healthstars and its directors, employees, contractors, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, opportunity, profits, or goodwill; or decisions made in reliance on the Service. Any limitations apply only to the extent lawful in your jurisdiction.
17. Suspension and termination
You may stop using Markers at any time. We may suspend or terminate access when reasonably necessary for security, legal compliance, misuse, non-payment for a paid feature, or material violation of these Terms. Privacy and retention obligations may continue after termination.
18. Changes to these Terms
We may update these Terms. We will post the revised date and provide additional notice when required. Continuing to use the Service after an effective change means you accept the updated Terms, to the extent permitted by law.
